Warranty conditions


The warranty extension is only valid for all Tobi solid wood products that were registered for the babybay guarantee from October 1st, 2024 using our form at https://support.babybay.de/en/product-registration/. The babybay guarantee includes the extension of the statutory warranty period to 10 years from the date of purchase. The rights of statutory liability for material defects in accordance with Sections 437 ff. of the German Civil Code (BGB) remain unaffected by the guarantee.

1. Validity
The guarantee applies to solid wood products of the babybay brand that are purchased and used by people for private use in the member states of the European Union, with the exception of overseas territories and islands. The warranty extension only applies to products that are advertised with or are marked with a 10-year guarantee. Textiles are excluded from the 10-year guarantee.

2. General
The guarantor is Tobi GmbH & Co. KG, Wildmoos 2, 82266 Inning . Regardless of the registration of the products for the 10-year guarantee, the consumer is still entitled to the statutory warranty rights in accordance with §§ 437 ff. BGB without restriction.

3. Requirements
The buyer is only entitled to a guarantee claim if he has registered the product within 90 days of purchase via https://support.babybay.de/en/product-registration/. A valid registration can only be made by submitting the original purchase receipt. After product registration, the buyer receives a guarantee certificate by email. A guarantee claim can only be made by submitting the following data and documents:

  • warranty certificate
  • Full name used during registration
  • Full address used during registration
  • Full email used during registration
  • serial number of the product
  • Date of purchase
  • Proof of purchase
  • Proof of damage as a picture

The guarantee is not transferable, so only the original buyer who purchased the product from a trading partner or from Tobi directly can assert the rights under the extended guarantee.

4. Scope of the guarantee
The guarantor guarantees the buyer the use of the product and the specifications of the product stated in the offer for a further 8 years after the expiry of the statutory warranty period. A defect will be remedied by repairing or replacing the item. The guarantee covers both the required spare parts and shipping. This service is free of charge. If Tobi has any doubts about the cause of the damage, Tobi can request that the consumer returns the product to Tobi at their own expense so that Tobi can check the guarantee claim.

5. Exclusions
The following circumstances or damage are excluded from the extended guarantee:

  • Damage caused by non-compliance with the manufacturer's instructions for use
  • Damage caused by natural wear and tear, overloading and abrasion
  • Damage caused intentionally
  • Damage caused by improper handling
  • Damage caused by the modification of products or the use of accessories not approved by the manufacturer
  • Damage caused by external influences such as water damage or improper storage of the products and other abnormal environmental conditions
  • Minor defects that do not affect the use or function of the product, such as paint damage or noise problems
  • Incomplete delivery

The guarantee does not cover personal injury and consequential damage, or damage caused outside the product. The guarantee expires as soon as repairs are carried out independently or without the manufacturer's approval.
As soon as the registered product is sold or given away, the guarantee expires on the day of sale. The rights arising from the extended guarantee can only be asserted by the buyer and first user of the product.

6. Processing
For defects reported during the guarantee period, the consumer will receive the spare parts required to remedy the defects as quickly as possible. If necessary, the entire product will be exchanged for a new replacement product. If the product is to be exchanged completely, the consumer is obliged to return the product in the original or replacement packaging with all accessories (if available) to the guarantor at their own expense. The consumer is responsible for all damage caused by the use of replacement packaging or by inadequate protection of the product. At the consumer's request, the guarantor will provide instructions for the correct packaging of the products.
A refund of the purchase price is not possible. The guarantee holder undertakes to provide all information regarding the circumstances that led to the damage completely and truthfully and to cooperate in clarifying the causes. If the guarantee holder does not comply with this obligation, the guarantor is entitled to refuse to provide the guarantee. Repairing or replacing the product does not extend the guarantee. If the consumer receives a new replacement product, this cannot be registered again for the guarantee. Claims under a guarantee must be made to the guarantor within six months of the damage occurring and before any repairs. The six-month period is a limitation period. If the period has expired, the guarantee claim is irretrievably forfeited.

7. Limitation period
Damage occurring during the guarantee period must be reported to the guarantor within 30 days of the damage occurring at the latest.

8. Applicable law
This guarantee is subject to German law.
