Right of withdrawal
Consumers have a right of withdrawal. Please note that Tobi GmbH&Co.KG only accepts products that were purchased via our website babybay.de. For products purchased from other points of sale, the respective retailer is responsible.
Withdrawal policy / Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods. To exercise your right of withdrawal, you must inform us (Tobi GmbH&Co.KG, Wildmoos 2, 82266 Inning, fax: 08143-99949-199, email: info@babybay.de) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or email). You may use the attached model withdrawal form, but this is not mandatory. To comply with the withdrawal period, it is sufficient that you send the notification of exercising your right of withdrawal before the withdrawal period has expired.
Consequences of withdrawal - Germany/Austria
If you withdraw from this contract, we shall reimburse all payments received from you, excluding delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this reimbursement. We may refuse reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever occurs earlier.
You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you informed us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.
The return or exchange of goods (from Germany and Austria) is free of charge for you, provided that the value of the returned goods exceeds EUR 40.00 and you use the free return label sent to you by us. For returned goods with a value of up to EUR 40.00, we will not provide a free return label and you are responsible for the return shipping costs. We refuse to accept returns sent carriage forward.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods. To prevent damage to the goods during return shipping, please use the original packaging materials whenever possible.
Consequences of withdrawal - Other countries
If you withdraw from this contract, we shall reimburse all payments received from you, excluding delivery costs, without undue delay and no later than fourteen days from the day on which we received notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in rare cases, fees may be charged for this reimbursement. We may refuse reimbursement until we have received the goods back free of charge or until you have provided proof that you have returned the goods, whichever occurs earlier.

Exclusion of the right of withdrawal
The right of withdrawal does not apply to the following contracts:
Contracts for the supply of goods that are not prefabricated and for the production of which an individual choice of or decision by the consumer is decisive, or which are clearly tailored to the consumer's personal needs,
Contracts for the supply of goods that are liable to deteriorate rapidly or whose expiry date would be rapidly exceeded,
Contracts for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene if they were unsealed after delivery,
Contracts for the supply of goods which, after delivery, have been inseparably mixed with other items due to their nature, contracts for the supply of audio or video recordings or computer software in sealed packaging if the seal was removed after delivery,
Contracts for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts.

Online withdrawal
For contracts concluded by you as a consumer via our online shop babybay.de and for which a right of withdrawal exists, you can also submit your withdrawal directly online.
To do so, use the “Withdraw from contract” button. You will then be asked to provide or confirm your name, details for identifying the relevant order and an email address for the confirmation of receipt.
By clicking the “Confirm withdrawal” button, you submit your declaration of withdrawal to us in a binding manner. You will promptly receive confirmation of your withdrawal by email. This confirmation contains the content of your declaration of withdrawal as well as the date and time of receipt.
