Right of Cancellation
Consumers have a right of cancellation. Please note that Tobi GmbH&Co.KG only accepts returns of products purchased through our website babybay.de. The respective retailer is responsible for products purchased from other outlets.

Cancellation Policy / Right of Cancellation
You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the last item. To exercise your right of withdrawal, you must notify us (Tobi GmbH&Co.KG, Wildmoos 2, 82266 Inning, Fax: +49 8143-99949-199, Email: info@babybay.de) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post, fax, or email). You may use the attached model withdrawal form for this purpose, but this is not mandatory. To comply with the withdrawal period, it is sufficient that you send your notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of Cancellation - Germany/Austria
If you cancel this contract, we will refund all payments we have received from you, excluding delivery costs (except for additional costs) resulting from your choice of a delivery method other than the one offered by us (the cheapest standard delivery), promptly and at the latest within fourteen days from the date on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will we charge you any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us promptly and in any event no later than fourteen days from the date on which you notified us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.
The return or exchange of goods (from Germany and Austria) is free of charge if the value of the returned goods exceeds €40.00 and you use the free return slip sent by us. For returned goods valued up to €40.00, you will not receive a free return slip from us and are responsible for the return shipping yourself. We will refuse to accept returns that are not postage paid.
You are only liable for any loss of value of the goods if this loss of value is due to handling that is not necessary to check the quality, properties, and functioning of the goods. To prevent damage to the goods during return shipping, always use the original packaging materials if possible.

Consequences of Cancellation - Other Countries
If you cancel this contract, we will refund all payments we have received from you, excluding delivery costs, promptly and at the latest within fourteen days from the date on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; in rare cases, fees may be charged for this refund. We may refuse to refund until we have received the goods back free of charge or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us at your own expense promptly and in any event no later than fourteen days from the date on which you notified us of the cancellation of this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period.
We will refuse to accept returns that are not prepaid.
You only have to pay for any loss of value of the goods if this loss of value is due to handling by you that is not necessary to check the quality, properties, and functioning of the goods. To prevent damage to the goods during return shipment, always use the original packaging materials if possible.

Exclusion of the Right of Cancellation
The right of cancellation does not apply to the following contracts:
Contracts for the delivery of goods that
are not prefabricated and for whose production an individual selection or specification by the consumer is decisive or which are clearly tailored to the personal needs of the consumer,
Contracts for the supply of goods that are liable to deteriorate quickly or whose expiration date would be quickly exceeded,
Contracts for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery,
Contracts for the supply of goods if, due to their nature, they have been inseparably mixed with other goods after delivery,
Contracts for the supply of sound or video recordings or computer software in a sealed package if the seal has been removed after delivery,
Contracts for the supply of newspapers, magazines, or illustrated magazines, with the exception of subscription contracts.
