Terms and Conditions
The warranty extension is valid exclusively for all Tobi solid wood products registered for the babybay warranty from October 1, 2024, using our form at https://support.babybay.de/en/product-registration/.The babybay warranty extends the statutory warranty period to 10 years from the date of purchase. The rights of statutory liability for material defects according to Sections 437 et seq. of the German Civil Code (BGB) remain unaffected by the warranty.

1. Validity
The warranty applies to solid wood products of the babybay brand purchased and used by individuals for private use in the member states of the European Union and Switzerland, with the exception of overseas territories and islands. The warranty extension only applies to products advertised or labeled with the 10-year warranty. Textiles are excluded from the 10-year warranty.

2. General
The guarantor is Tobi GmbH & Co. KG, Wildmoos 2, 82266 Inning, Germany. Regardless of the registration of the products for the 10-year warranty, the consumer remains fully entitled to the statutory warranty rights pursuant to Sections 437 et seq. of the German Civil Code (BGB).

3. Requirements
The buyer is only entitled to a warranty claim if they have registered the product within 90 days of purchase via https://support.babybay.de/en/product-registration/. Valid registration is only possible with the submission of the original purchase receipt. After product registration, the buyer will receive a warranty certificate via email. A warranty claim can only be asserted by submitting the following information and documents:
- Warranty certificate
- Full name used during registration
- Full address used during registration
- Full email address used during registration
- Product serial number
- Date of purchase
- Purchase receipt
- Proof of damage (image)
The warranty is non-transferable; therefore, only the original purchaser who purchased the product from a retail partner or directly from Tobi can assert the rights under the extended warranty.

4. Scope of the warranty
The guarantor guarantees the purchaser the use of the product and the product specifications stated in the offer for a further eight years after the expiration of the statutory warranty period. A defect will be remedied by repair or replacement of the item. The warranty covers both the necessary spare parts and shipping. This service is free of charge. If Tobi has any doubts about the cause of the damage, Tobi may require the consumer to return the product to Tobi at their own expense so that Tobi can verify the warranty claim.

5. Exclusions
The following circumstances or damages are excluded from the extended warranty:
- Damage caused by failure to follow the manufacturer's instructions
- Damage caused by natural wear and tear, overloading, and abrasion
- Damage caused intentionally
- Damage caused by improper handling
- Damage caused by modifying products or using accessories not approved by the manufacturer
- Damage caused by external influences such as water damage or improper storage of the products and other abnormal environmental conditions
- Minor defects that do not affect the use or function of the product, such as paint damage or noise problems
- Incomplete delivery
The warranty does not cover personal injury and consequential damage, as well as damage caused outside the product. The warranty expires if repairs are carried out independently or without the manufacturer's approval.
If the registered product is sold or given away, the warranty expires on the day of sale. The rights under the extended warranty can only be asserted by the purchaser and first user of the product.

6. Processing
For defects reported during the warranty period, the consumer will receive the spare parts required to rectify the defect as quickly as possible. If necessary, the entire product will be replaced with a new one. If the product is to be replaced completely, the consumer is obligated to return the product to the guarantor at their own expense in the original or replacement packaging, including all accessories (if any). The consumer is responsible for all damage caused by the use of replacement packaging or inadequate protection of the product. At the consumer's request, the guarantor will provide instructions for proper packaging of the products.
A refund of the purchase price is not possible.
The warranty holder undertakes to provide all information regarding the circumstances leading to the damage completely and truthfully and to assist in clarifying the cause.
If the warranty holder fails to comply with this obligation, the guarantor is entitled to refuse warranty service.
Repairing or replacing the product does not extend the warranty. If the consumer receives a new replacement product, it cannot be re-registered for the warranty.
Warranty claims must be submitted to the guarantor no later than six months after the damage occurred and before any repairs. The six-month period is a limitation period. If this period expires, the warranty claim is irretrievably void.

7. Limitation Period
Damages occurring during the warranty period must be reported to the guarantor no later than 30 days after the damage occurred.

8. Applicable Law

This warranty is subject to German law.
